Terms of Use

Welcome to Ocula. These Terms of Use ("Terms") govern your access to and use of the Ocula platform, including our website and related services (collectively, the "Service"), operated by Ocula ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using Ocula, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of the Service

Ocula is a personal health-tracking platform designed to help individuals living with Thyroid Eye Disease (TED) and Graves' disease organize their symptom history, clinical assessment scores, lab results, medications, and appointment records in one place.

Important: Ocula is a self-management and organizational tool, not a medical device or healthcare provider. Nothing on this platform constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any medical decisions.

3. Account Registration

To access the Service, you must create an account using a valid email address or a supported third-party login (such as Google). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.

4. User Content

You retain ownership of all health data, documents, and other content you submit to the Service ("User Content"). By submitting User Content, you grant Ocula a limited license to store, process, and display that content solely as necessary to operate and provide the Service to you.

You are solely responsible for the accuracy of User Content you enter. Ocula does not verify or validate any medical information you provide.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service or to any other user's account.
  • Introduce viruses, malware, or other harmful code to the Service.
  • Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service.
  • Use the Service to transmit spam, harassment, or abusive content.
  • Impersonate any person or entity.

6. Third-Party Services

The Service integrates with third-party providers, including Supabase (for authentication and data storage) and Google (for OAuth sign-in). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

7. Intellectual Property

All content, features, and functionality of the Service — including the Ocula name, logo, software, design, and text — are owned by Ocula and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA) and the Service does not constitute a HIPAA-compliant platform.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OCULA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNTS YOU HAVE PAID US IN THE PAST 12 MONTHS.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and governing law) will do so.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
